Confidentiality Policy
 

As an independent organisation we are under no obligation to disclose information to statutory authorities unless compelled to do so by a court order. However, in absolute and/or exceptional circumstances we may disclose confidential information with or without the client’s knowledge and/or consent. The organisation does not insist on obtaining client contact details, therefore disclosure may not be possible.

This policy generally relates to young people accessing the services of the organisation who are aged between 13 and 18 years. Where other young people (not necessarily clients of the organisation) are clearly at risk this relates to young people from birth to 18 years.

Disclosure may also take place in exceptional circumstances where it is clear that a young person aged 13 to 25 years is unable for any reason to make an informed choice about their actions or the actions of others, for example where a 23 year old presents with a serious mental illness and any of the exceptional circumstances within the policy are evident.

Exceptional Circumstances
In such circumstances, every effort should be made to allow the client to address the problem themselves, wherever possible and with support.

When a young person discloses to their helper that they are being abused in any way and are at risk of significant harm – for example when a young person is being exploited for the profit of others, When other young people are considered to be at significant harm, for example siblings.

When a young person discloses to their helper that they intend to or have already significantly harmed another person/people for example disclosure of intent to murder/rape or other life threatening action.

When a young person discloses to their helper that they intend to or already have taken action to significantly harm themselves for example where a young person has taken an overdose or is in the final stages and preparation of a suicide attempt. This does not include self harm in relation to an ongoing mechanism

Time 2 Talk operates a confidentiality policy within the agency. This means that whatever you disclose here will not be discussed outside with any person unless you want us to, in which case your signed consent must be given

The exceptions are as follows:

Confidentiality WILL be broken if you tell us.
If you are involved in an act of terrorism
OR
If you are in any way involved in drug trafficking

Confidentiality MAY be broken in exceptional circumstances such as:
If yourself or someone else is being harmed
If you intend murder rape or threaten harm
If you have taken an overdose or are in the final stages of a suicide attempt.

We would, however, discuss with you first, that we intend to disclose what you have told us and will work with you to enable YOU to make the disclosure wherever possible!
